THE WHAT? Nykaa has settled a long-running copyright infringement litigation with L’Oréal, with shares up 5 percent following the news.
THE DETAILS L’Oreal first filed a civil suit in Delhi High Court to allege copyright infringement, stating that some Nykaa packaging resembled that of its trademark Maybelline brand, which the company said was an infringement of intellectual property rights.
The court of Delhi later passed an ex-parte order, which Nykaa appealed. Both companies opted for a settlement, approved by the Delhi High Court.
THE WHY? Under the settlement terms, L’Oreal has approved modified artwork, and will press for reliefs of damages, rendition of accounts and any costs against Nykaa, according to Inc 42.
Both parties will not make any claim against each other or claims relating to payment of costs or charges in relation to the settlement.
